Terms of Service / Private Session Agreement
I understand there are no refunds given for private sessions. I understand that my appointment is reserved especially for me. Sometimes schedule adjustments are necessary. Therefore, Coach Beth respectfully requests at least 24-hour notice for rescheduling of an appointment. I understand it is my responsibility to remember appointment dates and times in order to prevent any missed appointments. I understand any late arrival will shorten my appointment time and will not be made up.
Emergency absences will be considered on an individual basis by Coach Beth. Send a consideration request to coachbeth@blueowlsolutions.com within 5 days of a missed appointment.
It is mutually understood that if a cancellation is due to circumstances beyond any of our control, such as widespread power outages or severe weather, rescheduling the existing appointment will be an option with no financial penalty.
Coach Beth believes it is only fair to honor the same policies to her clients. If Coach Beth deems it necessary to cancel with less than 24 hours’ notice of the appointment scheduled, she will honor rescheduling your next appointment free of charge.
Terms of Service / Membership Agreement
This is an Agreement between You, the Member, and Blue Owl Solutions LLC, (“Us” or “We”).
By following the joining process at www.blueowlsolutions.com to become a Member of any Blue Owl Solutions LLC group, activity, or session, you are accepting the terms and conditions in this Membership Agreement.
Your Rights
- This Membership Agreement starts once you have accepted the terms during the online joining process. By accepting the terms, you are agreeing to pay any applicable Membership Amount which are shown at the start of the joining process and again before confirming your payment instruction.
- Your Blue Owl Solutions LLC membership will start immediately from the time you accept the terms and pay your initial membership fee.
- For Blue Owl Solutions Memberships LLC, you are entitled to all open drop-in hours, printable worksheets, podcasts, group activities and special events organized by Blue Owl Solutions.
- We will make reasonable endeavors to communicate to you in advance if we are unable to make available to you the rights and privileges of Membership.
- You have the right to a positive and beneficial group experience.
Cancellation Policy
- You have the right to cancel this Agreement for any reason within the first seven days of membership. Simply email coachbeth@blueowlsolutions.com and provide your Name, Address, Phone Number, and Username.
- In case of dispute you must show that you cancelled the Agreement in accordance with the cancellation terms.
Refund Policy
- Blue Owl Solutions LLC provides a full refund of Membership fees upon request within the first seven (7) days of membership. Per the Cancellation Policy above, we will cancel your membership and refund any payment processed. There is no refund for Private Coaching Sessions purchased.
Your Obligations
- You agree to pay us the applicable 1-year Group Membership fee when you join online.
- You permit ongoing direct debit or credit card charges to the account specified to be charged every year for Blue Owl Solutions LLC Memberships.
- Your first Group Membership payment is due upon joining online and each subsequent 1-year period commencing from your “join” date.
- You agree to pay us the Blue Owl Solutions LLC Group Membership Fee whether or not there is any temporary interruption in your use of services during the period.
- You agree to maintain a currently activated debit or credit card account for payment processing.
- If any payment due from you is not honored, you will be notified that your Blue Owl Solutions LLC Group Membership has been terminated due to non-payment. You can reinstate your Group Membership by providing updated debit or credit card account information for processing.
- You confirm that you are at least 18 years old.
- You agree that you have read and understand our privacy policy which is available below.
- You agree to tell us immediately of any changes to your personal details including contact information and payment method.
Our Obligations
- We provide a variety of at least three different time choices, including but not limited to, one morning session, one mid-day session, and one evening session of Blue Owl Solutions LLC group, open drop-in hours per week, schedule to be posted on www.blueowlsolutions.com.
- We provide a variety of special events, such as but not limited to, virtual book club discussions, podcasts, health and wellness journey worksheets, virtual Q&A sessions with Coach Beth and other special guests.
Our Rights
- We may terminate this Agreement and your Membership with immediate effect if you do not pay any applicable Group Membership amount when it is due.
- We may terminate this Agreement and cancel your Membership with immediate effect on notice to you if you consistently breach any of the Group Membership Rules outlined by your coach, causing an unpleasant and/or unbeneficial experience for other group members.
- If we do not terminate your Membership if you breach any of the Group Membership Rules, or if we give you extra time to pay if you do not pay your Group Membership amount when it is due, we may subsequently enforce the terms of this Agreement.
- We may communicate Blue Owl Solutions LLC related information to you by email or SMS.
- We may assign the benefit of this Agreement and our rights to a third party provided we give you notice and your rights under this Agreement will not be prejudiced.
- We may make reasonable changes to Membership Rules and to the Membership Agreement terms and conditions at any time.
- We will send to you email confirmation of these terms using the email address you used when you joined.
Other Clauses
- Only you, the person named in the online joining process, can benefit from this Agreement.
- If any of the terms of this Agreement are invalid, unenforceable or illegal the remaining terms can still be enforced.
- This Agreement is governed by the laws of the State of New York.
- You may print a copy of this Agreement for future reference.
Both Parties Agree
- Professional coaching is not therapy, counseling, advice-giving, mental health care, or treatment for substance abuse. A Coach is not a substitute for professional medical advice, financial assistance, legal counsel or other professional services.
- Coaching is for people who are basically well-adjusted, emotionally healthy, functioning effectively, and wanting to make changes in their lives.
- Coaching is designed to address areas the Client would like to consider. These could include (but are not limited to) life goals development, mindset enhancement, health and wellness, productivity, and fulfillment. Coaching can involve exploring perspectives, brainstorming, questioning, goal-setting, examining lifestyles, education, agreements to change behavior, and accountability.
- Coaching is a confidential relationship and the Coach agrees to keep all information strictly confidential, except in those situations where such confidentiality would violate the law.
- Coaching assumes that each person in the coaching relationship is guided by his/her own beliefs and values, and these are respected.
- The Client is fully responsible for his/her well-being during the coaching relationship, including his/her choices and decisions.
- The Client is responsible for his/her own achievements and successes and the Coach does not promise that the Client will take any specific action or attain specific goals.
